non resident, sold irish property, need tax clearance and CG1

Hello,
we sold our property in citywest a month ago. We were expecting our proceeds but they are being held by the solicitor until they get the tax clearance from revenue as we are non-resident.
I have been told to do a CG1 form but i'm a little confused for a few reason:
- we are making a loss on that sale (bought for 295K in 2007 and sold this year for 292K)
- the CG1 form seems to be for 2024. initially I did one claiming 0 as we have no loss this year.

Also they are asking me for all my form11 for rental income but i can only access 6 of them on ROS.

How can I proceed? do I need an accountant?

If you have Income Tax arrears and are unsure about how to obtain the necessary CGT Letter of No Audit clearance, you pretty much definitely need professional assistance and advice from an accountant or tax professional.
 
That’s the thing, there is no tax arrears, actually revenue owes me 3k from the 2024 form 11 (my rental tax is always withheld by the agency because I’m non resident).

i have no CG tax gain in 2024, this is clearly stated in my form 11. I will have a loss in 2025 for the appartement sale, but is that not to be declared next year?

My problem is that I really need this tax clearance now from revenue so the solicitor can transfer our proceeds to us…

Tax clearance

A Tax Clearance Certificate is confirmation from Revenue that an applicant's tax affairs are in order. Revenue may issue a tax clearance certificate to a customer who has tax arrears where the arrears are covered by an instalment arrangement.

Any recommendations of an accountant that you could recommend to accelerate all of this? We are depending of the proceeds to purchase another property on the 15th of July.
 
So yesterday I received acknowledgment of my 2024 form 11, I have a IT 2024 statement, CG 2024 statement and full statement where they states that they owe me 3000€ of tax for that year.
- Can you confirm that doing a separate CG1 for 2024 is redundant as it is already included in my form 11?
- Can you confirm that I will need to fill in a CG1 form next year before october for the sale of my house this year although i made a loss?
- Do i need to ask for this Letter of No audit myself? the solicitor never mentioned that to me...
 
You sold the property in 2025. A CG1 is needed for 2025 (not 2024) and it's needed now, urgently.

You won't get your Letter of No audit until it is submitted, and Revenue are 100% happy that its contents are correct and in order, that there are no further taxes owing by you and that everything overall makes sense from their perspective.
 
You'll have to create one yourself - Revenue stupidly only make these available in the following year - but you really need to hire an accountant to handle this.
 
Thanks for the advice, I made one myself. I have done CG on form 11 when I was still living in Ireland for company shares so the form was not too difficult, I just changed the year to 2025. I sent it and I really hope this is what they were looking for.
