We have been renting an apt. for 2.5 years. Initially we signed a 12 month lease and we have not received a new/replacement lease since the 1st one 'expired'.
After the 1st 12 months we had a rent review where the rent was increased and after the 2nd 12 months we had another rent review where the rent was decreased. After these rent reviews we did not receive any new lease.
Since we moved in, we have broke one cup and one glass. Apart from that the apartment is spotless and as it was when we started renting it.
My question is: Can the landlord withhold our deposit until he gets new tenants in or can he refuse to give it back altogether?
