Just a quick query guys. I signed a 1 year lease through agent at end of 2009 and again a year later. LL/agent didn't look for another lease end of 2011. I will be moving out in a few months and just wodnering what's the notice period I should be giving the LL? Cheers.
No lease signed gives you an unwritten Part 4 tenancy as defined in the Residential Tenancies Act 2004.
As you have been in occupancy for more than 2 years (if I have calculated it correctly) you are required to give written Notice of Termination (sample Notice with help notes available on the PRTB site) with a notice period of 56 days - the maximum required of a tenant.
That's great thanks for the information, cheers. One other thing, is it possible to use deposit as our last months rent? LL is very difficult to get a hold of and doesnt respond to txts/calls so I know I'll have lots of trouble trying to get deposit back off him, cheers.

I could never advocate breaking the law. The law states that you cannot use your deposit to pay any portion of the rent.
Furthermore, if a claim is made to the PRTB (by either you or the landlord), the PRTB take a great dislike to tenants who use the deposit as the last month's rent and it is likely to affect their decision.
Thanks for the responses guys. I obviously don't want to break the law but know that there will be definite issues getting deposit back. I might delay putting in this months rent and he'll make contact then.
