I re mortgaged my home in 2008 in order to pay divorce lump sum payments. At the time I asked in the tax office if I was eligible for interest relief and I was told to fill in the requisite form and I have heard nothing 'official' since but their customer line said that it appeared it was counted as being the same mortgage going forward and was not eligible. However I did not get a response to my application .

I am not complaining about the lack of response here - or my own inertia since - I am just asking if a re- mortgage IN LATE 2008 and top up by 100,000 totalling 350000 in all is total outside of the tax relief. From memory they seemed to think I was pulling a fast ONE. however, I was treated as a first time buyer after the divorce and did not have to pay the stamp duty on the re-mortgage and transfer of the family home to me so on one hand they appeared to be recognising the transfer whilst on the other they don't.

Yes its all outside. Mortgage interest relief is based on the original loan for the property and not additional borrowings outside of that.
 
But what if the money was used to purchased the ex's share in the property. The OP might clarify what exactly the proceeds of the loan were used for.
 
Query re Interest Relief on Investment Propert

Apologies if I am in the wrong section but I have just registered and could not find the post a query section.

During 2012 I have received the standard monthly interest demand from my bank. It amounted to €62k for the full year but I was only able to pay €40k in 2012.

In my Revenue calculations for rental expenses do I show interest of €62K which accrued for 2012 or just the €42k I paid in the year.

I suspect alot of people who are in arrears with their bank will have a similar query
