Maternity Leave: do my company owe me commission?

Hi,

I am hoping someone can help me with this question.

I had a baby girl in Feb this year and have decided recently not to go back to work. I havent yet told my job that i dont intend to come back, am gonna do that soon.

Anyway I ran a dept that was sales orientated and i earned commission from all sales generated for my dept in the company.

I have heard that the company owes me holiday days since i have been off on maternity leave, as they still regard me as working full time so i am entitled to those days (??), but what i am wondering is if i am therefore also owed my commission for the time i have had off?

If anyone of you have any idea i would really appreciate your help.

Your time on maternity leave is treated as if you are still employed normally so that fact and your contract of employment should clarify whether or not you are due commission in respect of this period.

Sahm, you were running the Sales Dept....if one of your staff was out on ML in the past did they get there Commiission? If so, then you should get your share now, if not......you should'nt.

If this situation has not arisen previously, then how would you feel about sharing Comm. with someone who was out for months and not contributing.....thats the question, and YOU know the answer!

I would think it is worth asking for the commission anyway. I have several friends in Sales and one of them recently put a lot of effort into getting forward bookings for the next six months specifically so that her commision levels wouldn't go down while she is off work. It really does depend on whay type of targets the commission you are paid is based on. Maybe you could give some more details?
 
hi , sorry a newbie here and not sure how to start a new post , my question is very similiar though , i go on maternity leave in 12 weeks and for the last 1half year I have earned my salary plus commission paid on any new clients,clients that pay on a monthly basis and any clients that renew.
I have been told that legally I am not entitled to any of my commission on maternity leave ,how ever these are my clients that i have worked hard to get and some of them will still pay on a monthly basis while im on maternity leave .

I am the first ever person to go on maternity leave at this company so its all new to them but feel I am being done out of whats mine here .

can anyone help?i cant seem to find the answer anywhere.
i am paid 10% commission on all new clients,on going clients and renewals.

hi all,
im out on my 3rd period of maternity leave, yes you are entitled to holidays etc. You would not be entitled to any commision. It is even at the discretion of the company to pay you your wages(difference between socail welfare payment and actual salary). That is something companies do out of goodwill. You are not legally entitled to it.
