Ongoing court case with Bank and family dwelling. We had been involved in trying personal insolvency arrangement for past while and had protective certificate issued. There was as expected, a lot of information to collate and confirm. Just at the stage the proposal was ready to be put to the creditors, it was decided it would not be feasible to proceed and a decision was made by the PIA not to call a meeting. From what I can gather the bank had advised they would reject it and were looking for other commitments that were beyond our control. The certificate has expired now and the facing the bank in court again next month. Any advice welcome

Thanks Gahfan. Yes have not missed one court date yet. Just ongoing frustrating battle where meaningful amount being paid but cant get a deal

Can you give more detail ? Just because the bank won't accept a PIA doesn't mean it can't be pushed through by the court.

It didnt even get to vote stage. When the proposal and figures were being drafted there was contact made with the bank by the PIP and they told her they would reject it and put some conditions of their own in which confused us as we thought it would be proposed and either accepted or rejected. We were not aware that the Bank would be included in the workings of the proposal itself. So we ran out of time on the protective certificate and that was that. The creditors meeting never took place so in essence there is nothing to appeal and now we have to wait a year before applying again ... and unfortunately the bank have us back in court in a couple of weeks.
