Do you need to be living apart from your ex spouse for a set period of time or the entire year to qualify for this.

As far as I am aware, as long as you are living alone with the child you qualify for the Single Parent Tax credit, and if your ex has the child for a time also he will also qualify. As long as you can prove you no longer live toegther I do not think it is an issue.

Just a note as this caught me out; If you are getting TRS as a coupld in the home be aware that the person who moved out will looser there TRS on the mortgage. A you dont qualify for TRS if you do not live in the home.

i have spoken to the revenue about this before and they advised if the person is not co-habiting for any part of the year than they are entitled to the full lone parent credit etc. however i would advise ringing the revenue 1890 paye line and querying it again to be sure. revenue can tend to give different answers.

Well I will put in for last year so. It does sounds open to abuse, sure if a couple lived apart for a couple of weeks every year are they entitled to the credits?

exactly, thats why im sceptical about the revenues advise. its sounds too good to be true. Im actually querying it again so i will let you know how it goes

i spoke to a few individuals yesterday in the RC and they all advised a person is entitled to the TC if they are not co-habiting for part of the tax year. now, like every other TC and as the Irish tax system is a 'self assessed' system the onus is on the individual not to abuse it and take advantage. e.g if a couple live apart for 3 weeks cause they had a domestic than you cannot claim the TC, however if a couple were living together and than seperated in say May this would be a situation where the TC may be applicable. thats my take on it anyway...obv Im open to others advise & opinion.
