Hi my mama and dad legally seperated 24 years ago. She got the family home and my dad purchased another home for us. He passed away and left his house to myself and my brother. Will my mother be able to make any claims on the house and will this delay probate.

Show the Separation Agreement or Judicial Separation Order to a solicitor and they'll tell you.

While it is usual for separating couples these days to waive any claims they may have under the Succession Act, it is by no means a given- and even more so, if the separation occurred 24 years ago.

Thanks.. I doubt she will go after anything. She's have a neck. Considering we where all left homeless only for my father buying another house which took a lot to do. But I think it will probley lengthen probate.
