Leaving employer before signing contract

Hi,

My wife started working a couple of weeks ago but still has not signed the contract. She was given a written contract with the offer expiring in about two weeks from today. She has decided to leave the job as she is very unhappy with the job, the colleagues, the manager, etc. Given that she has not signed the contract yet, does she have to serve any termination period? Is she entitled to be paid for the two weeks already worked?

In answer to the second part of your question is - your wife is fully entitled to receive payment for the weeks and hrs that she worked. If there is a non-payment of wages by her employer it then comes under the provisions of the Payment of Wages Act 1991.

To get clarification on notice - you should contact the National Employment Rights Authority on whether notice has to be given - but given she has not signed a contract - I would think she's under no obligation to the employer - and even if the case is true - they are hardly going to pursue her for not giving notice.... but check it out with NERA first.

If your wife is going to claim jobseekers - just to let you know that she may be disqualified for up to nine weeks if they consider that she has left her job without good reason.
