Leaking Toilet & Problems with builder

I am in my new house about 14 months. Since moving in there have been numerous problems with the plumbing. Stupid things that were never done correctly when the house was built. Most times the site foreman sent the plumber around. On a few ocassions though I paid for a plumber to fix.

Anyway, since moving in the toilet in one of the ensuites has been leaking out the back - where the toilet and waste pipe connect. So far 4 plumbers have looked at it and wrapped tape, silicon and all sorts around it but it is still leaking and dripping water onto the tiles, which eventually goes through the tiles and marks the ceiling about the kitchen.

I rang the builder last Wednesday. He said contact the foreman of the site which I did and he sent a plumber around on Thursday. Plumber looks at leak and blames tiler. I just said this leak was written on the snag and was never fixed properly. He then says its a big job - toilet, tiles etc need to come up - I just smilled and said I dont care but it has to be fixed. He said he would talk to the foreman.

That was last Thrusday - It is now Wednesday. I have rang the foreman everyday since and left messages but no answer and no call back. Can anyone give me advice on what to do. Should I just get someone in to fix it and sent the bill to the builder.

Write to the builder, c.c. the foreman in on the letter and ask when this job which was originally on your snag list will be completed to your satisfaction.
 
how did your solicitor allow you to purchase when the snag list wasnt completed!!!!

there should always be a defects liability period of 6 months, in which the builder is liable for any defects, and usually 5% of the contract price should be withheld until this period is up.
 
When the snag was completed it had the box ticked to say the wet patch had been sorted.

I have sent an email to the builder demanding that this be sorted ASAP.

then i would say you have a case... the builder claimed the snag wa fixed when obviously it isnt...
