Hi all, in December 2009 I was unfair dismissed after almost 3 years service. In April, under the two acts (Fixed Term Work Act and Safety, Health and Welfare at Work Act) complaint has been sent by my lawyers to the LRC and to the employer. The employer is one of the biggest companies in Ireland and the complaint consisted of many cases of breach of employee rights. My question is whether, in the case of an appeal (which presumably will be) the case will not be out of time (six months)? I mean referral to The Equality Tribunal.
Second question, can I now submit the matter to The Equality Tribunal before the limitation period has elapsed, despite the examination of the case by the Rights Commissioner.
