Hi,
Is it usual that a contractor is not allowed to terminate while the agency can give one months notice? It means that even given unforeseen circumstances e.g. death or illness in family, the contractor might be forced to continue working to the end of a contract.

Any views on this from seasoned IT pros?

I'm definitely not a seasoned pro, I've only contracted for 2 different agencies but both had the clause that either the agency or the contractor can terminate the contract with one months notice.

Have you already signed this contract. It seems very restrictive and I would have issues with signing it without the agency changing that clause.
Have you asked the agency about it?

I've never heard of such a condition and wouldn't entertain it myself. I seriously doubt whether it's enforceable, although an agency which put such an unfair term in a contract might try to rely on it to avoid making payment if you did have to terminate early.

It's a three month contract and I know given the shortness that a notice period may have less relevance. I have resolved the concern as the company I am dealing with are re-drafting to give a 1 month notice period on either side. It was more the approach taken as it seemed the contract was being held back from me until I actually started work. This left me at a disadvantage and made me concerned at their general approach.
