Is it a new build (re. stamp duty)

My colleague and her husband are currently buying a "new" house.
The house was built and complete in March 2005 - it was never lived in. Was only put on the market in June 2006 - and they are in middle of signing contracts. Solicitor is unsure if they are liable for stamp duty as the regulations state that a reasonable period of time from when it is built to when its sold on applies. Size of property is OVER the 125 sq foot and they accept they have to pay some stamp duty. Would anyone know if they are to pay the full Stamp Duty at 6%? Value of house Euro 381K

Is the house being sold them as new or secondhand?
 
Techman she says it is a new house - never lived in. Solicitor thinks there might be a time frame as what constitutes a new build?
 
I think that once a house has been sold by the builder to an individual, it can't be sold on as "new" by that individual, even if it has never been lived in. Think they will have to pay the stamp duty as if it is second-hand. Sorry!
 
Marg is right, its not whether it has ever been lived in before, its whether it has had any previous owners or not. if the builder is selling directly to them having never sold it to anyone else, then its new, it the builder has sold it on already and the owners are subsequently selling it, then it is second hand.

Are they the first purchasers from the builder?
 
Yes the builder is the seller - they are the first purchasers.
