Intestacy and Fair Deal Scheme

My father died intestate 7 years ago. His is the only name mentioned on the deeds. If my mother ended up in a nursing home in the not too distant future would she be entitled to free care if the house is not in her name.? i.e. if she has no assets in her name. Or is it the case that because she is legally entitled to two thirds of my late fathers estate the Fair Deal scheme would still apply in this case.

She will be treated for Fair Deal purposes as owning a two-thirds share in your father's estate.
