Injunction - out of pockets expenses

We have an injunction pending and have attached out of pocket expenses. The case is based on the developer failing to abide by our contract and provide services (which we have paid him for) necessary for our planning. We've been delayed 3years already.

Is it likely that the judge will disregard our expenses due to the increase in value of our site when the work is complete and planning subsequently granted?
 
Hard to know. Depends on circumstances. All you can do is document everything and seek them. It is worth making the point that you would have been entitled in any event to the benefit of any increase in value if the problems had not existed.
