HELP Childcare - Solicitor Query

Hi all,

my girlfriend is a childcare worker for a private family in their private home. She's doesn't get paid by the family but by a solicitors company the couple work for. Is this legal? Also she does not have a contract, should she have one from the solicitors company or the family?

Does she get a payslip and (if she has been there since last year) a P60 at year end? Are they deducting tax and PRSI? Every employee is entitled to a contract, but there may be a question as to whether she is actually an employee, or a contractor.

Given that the solicitor is doing the paying, one would hope that they are keeping things legal.

At the beginning she got no paysilps just paid into her account, now she gets paid by the company and pays prsi and tax....
