Harassment Suit-Advice Plz

Hi all,

I hope you can shed a bit of light on this situation. My girlfriend is a General Manager of a Fitness Center and has just been informed that a harassment suit has been brought up against her.

Last week she gave a member of staff a written warning (recommended by her Regional Manager) for consistent misconduct. These incidents had been recorded by my girlfriend and on the advice of her Regional Manager she informed the member of staff that a written warning had been raised.

As a result of this the member of staff lost the plot saying that she had never been treated so badly that a verbal telling off would have been sufficient but as my girlfriend informed the staff member that there are guidelines and procedures in place and that giving the member of staff a written warning was required for the constant infringement.

Today my girlfriend got a call from the company manager saying that a harassment suit was being brought against her from this member of staff.

This is my girlfriend 1st ever harassment suit so as you can imagine she is a bit worried. Do you think that she has anything to worry about?

I would imagine that as she discussed this situation with her Regional Manager and dealt with the staff member on the advice of the Regional Manager she should have nothing to worry about she has done everything by the book but do you think that the staff member has a case?

Any input would be greatly appreciated.

As long as she went under the advise of the regional manager and applied company disciplinary procedure correctly she shouldn't have a case. I would ask the regional manager to try to mediate the situation so it wont escalate to labour relations ect.... this is in the companies best interest
 
Doesn't sound like there is anything to be worried about..She followed due process and as long as she didn't say anything inappropriate and was professional throughout it all I'm sure she will be backed up by the company and it will all be ok.

You might want to consider though that you have posted in a public forum and the info you posted is pretty specific and might be recognised...
 
If your GF is found guilty, the company will be punished.Your GF followed Companys policy, so blame cannot be attached to her.


The case you highlighted will be thrown out, but this is only your GFs side, so you will have to wait to hear both sides ..
 
Was she operating on a direct instruction from the Regional Manager? Is this instruction in writing?
