GEtting stamp duty refunded on investor property

hypothetically if someone has no PPR and buys a property as an investor and pays the stamp duty owed.

Lets say the very next day after paying the satmp duty they change their mind and decide to declare it as their PPR instead are they entitled to get the stamp duty refunded?

Or is it too late at that point?

Seems quite harsh if it is too late.
 
Umm.

They had to make a decision. Its an investment OR its a PPR. They have minimum several weeks or months to make that decision. They make that decision. And then change their minds. The next day.

I assume they have a mortgage also so they would have discussed this with the lender and their own solicitor.

I think its too late.

No its not to late. Get your solicitor on the case and get them to write to the revenue outlining that you paid stamp duty in error and that the house will be used as your PPR and not as an investment property. I had a similar situation a few years ago and got the stamp duty refunded.
