Hi
I am working in a childcare centre that gets funding from various goverment office mainly the office of the Minister for children. This funding is adminestered by Pobal. The childcare centre which is community run and not for profit had to form a company this year to comply with getting their funds from pobal. Now the problem is that we have been employed here for 4 years under one tax number but now they are changing the tax number and giving us p45 at the end of june and on the first of july we will be employed by this limited company. My query is if this place closes in a year or 2 or one of the staff is let go due to falling numbers what implications will be from accepting a p45 now. Can the staff object to getting a p45 when still keeping the jobs. Any advice please.

There shouldn't be a problem. You have to get a P45 as your employment is ceasing under the current number. It's not possible any other way.

Same thing happened me a few years ago when one partner left the firm. The partnership ceased and we all got a P45. We were immediately re-employed by the remaining partners.

In short there will be no implications in accepting the P45.

As per Half Slicer. Revenue's computer systems require this when changing employer numbers . The 'company' can easly can get permission (a letter) not to issue P45s, but this is just a paper saving exercise.

But if the place closes or leaves one employee off will they the the statutry redundency from just the lenght of service with the new tax number or will they get it for the whole time employed under both numbers as it was the one job.

Under TUPE, which is the European legislation for the protection of workers rights in the event of the company they work for changing ownership, your length of employment is not broken.
Therefore, for redundacny purposes, you would get it for the whole time you were employed.
