Can anyone accurately tell me my rights.

I have been working for a state organisation as a trainer and I have been delivering training programmes which typically take 6 months to complete.

Even so i am only given continuous 1 month "rolling contracts" which are in effect photocopied contracts with the date changed. I have worked here for 9 months (on this occasion) and now i have been released so as i do not have a claim to a full time position.

i have been replaced by someone to do exactly the same work as i have started i.e. finish the programme.. is this proper?

my work was always very good and i am only being released so the organisation can dismiss it obligations under employment law?

Re: Fixed Term contracts

adrian,

the org is within it's rights to terminate your contract at any stage as long as it abides by the notice clause in your contract, employers are getting very nervy about agency and temp personnel claiming full time positions usally after 12 months of service where unfair dismissal legislation comes into effect, as an end date on a contract can be viewed as not being a justifiable cause for termination. this can be an extremely grey area that you have been caught up with.

They are doing nothing ill legal by replacing you.

Thye should in effect have given you a fixed term contract for the 9 months or put a provision in your contract if directly employed or if through an agency that
the Unfair Dismissals Act, 1977-1993 shall not apply to your dismissal consisting only of the expiry of the period or cesser of the purpose.
