As in John already enjoys a life interest ? 20 year interest in a property which passes to his brother Michael in 2025. The freehold title was owned by Maria , now deceased. John's interest will lapse in 2025 and go to Michael.
John is a beneficiary and and executor. A third brother, Alan, is the other executor. John wants to sell the property and Alan does not. Can John force the sale?
John can't force the sale as Michael has an interest in expectancy. Unless Michael joins in the sale. But a sale can't happen unless Alan, as the other executor joins in the sale
