I heard the Director of the RTB on the radio this morning and she emphasised that if you sign a tenancy agreement and later find that the rent was more than 4% higher than the previous tenant's rent, you can get the RTB to reduce your rent to the correct level.
A tenant cannot contract out of the law.
And you have 6 years in which to make the claim.
This creates a huge amount of uncertainty for landlords. They refurbish a property and rent it at the market rent. Then the tenant claimed that it was not refurbished and goes to the RTB. The property might not meet the RTB's specification:
