DublinCoCo dispute, Previous tenants non payment of BinCharge

I have an outstanding bin charge attached to a property I let to tenants approx. €500.

This bill has built up over the course of 2 previous tenants. The first tenant just didn't pay for his bins and the second tenant never paid because the bin charge bill was not sent to him. Despite me informing the co co in writing they never changed the name over to the new tenant.

In Dublin CoCo there is a flat fee of €5 per week and €3 per bin lift(I think). They seem to just keep taking bins even if people don't pay their bin charges.

Now I have a new tenant who is on social welfare and has been informed by the council that they cannot avail of their bin waiver (which they are entitled to) until the €500 bin charge is paid of the house.

The Coco said that they will not change the account name until the account is settled.

I have a number of issues here.

1. The coco is discussing monies owed on the house with the tenant.
2. Have they a right to withhold the tenants entitlement to free bin collection just because previous tenants/me have not settled their accounts.

3. The €500 bill is in the first tenants name. Why should I have to pay this charge. (I informed the coco in writing that he had left) The ESB and gas bill accounts were written off as bad debts and the accounts were changed to the new tenants without any problem. Why should the bin charges be any different.

4. How can the coco just keep on taking the bins and just add it to the bill?


Does anyone know who I can turn to complain etc. The coco seem to have me over a barrel. Would the Dept. of Environment be any use?

It is your house & if you were selling in the morning you would have to produce a statement from the council to say that the account is paid in full. I suggest you put in the lease agreement that the tenant changes that account over into their name ( like the ESB) and produces a receipt to you of the paid biill on departure before you give back their deposit

I know all that, but thanks anyway for your response, my issue is with the way the council is handling the situation and the fact that they continue to take bins from the house despite no one paying the bill

Have you put this to them? What did they say?

It's quite difficult to deal with them.....It's Dublin City Council don't forget. When I talk on the phone they say I have to put it in writing. When I e-mail, I get no response.

I'm going to try their complaints department and if I don't get any satisfaction then I'ill go to the department of the environment complaints department.

I really think they should have no right to deny my new tenants right to a bin waiver just because my previous tenants and/or me did not settle their accounts.

I know I will have to pay to the unpaid bin charges of previous tenants(or at least some of it, if I can negotiate a settlement, in fact I retained a portion of my last tenants disposit to cover that tenants bin charges) but this business of not allowing my new tenant avail of her welfare rights is a bit ridiculous.

Hi Don,

Do you owe the money to DublinCoCo or is it the previous tenants?

Why not write them a letter an send it to them via an post. You make a reasonable case here so I assume they would respond positively.

Its the two previous tenants that owe the money. Yes I agree, I'ill have to use post rather than e-mail. It looks like they don't pay much attention to e-mail in Dublin CoCo.
