Yes, but you don't have to actually build the gizmo. This is the dodge used to patent software or processes, embodied in a machine. Of course, just because a patent is granted doesn't necessarily mean the patent is valid.i think you can only patent an implemenation of an idea , basically some sort of gizmo.
