Creaking Stairs in new house - can i go back to the builder?

I moved into a new house at the start of November. Got a carpet on the stairs and landing some weeks after that. The top stair at the landing is creaking quite loudly now and I dont think I can do anything to fix it without taking up that part of the carpet.

Is this something that I could go back to the Builder about and ask them to fix it?
 
Absolutely -something may just need to be tightened so either the on site carpenter or the stairs supplier should come back to investigate the issue. Phone them and put it in writing to them on the same day (fax or email is sufficient). If you don't get a call within a week, repeat the process.
 
The problem is that I have a carpet laid now and I presume that it would need to be taken up in this area in order to tighten up anything that needs to be tightened. I cant see the Builder agreeing to pay for the carpet to be taken up or put back down.
 
Surely the builders tradesmen could easily remove and reset the carpet...I would also request / have this clarified in writing.
