Construction Sick Pay

Hi
My Brother in Law has been off work with a back problem which resulted in an operation and it seems he will not be able to work in the short term.
He is a 1st/2nd Fixer/Roofer.
He has been told that he may be entitled to Sick Pay under the Construction Industry Federation. Is this the Case? please advise if anyone has come accross this similiar situation

I would say no contributions were paid to CWPS or is a member of CIF
Would his employer have to be a member of CIF as well as himself to claim under this scheme?

His employer would have to be a member of CWPS but AFAIK they are obliged to be a member if they are in the construction industry. They would then have to make employer contributions and deduct employee contributions from your BIL. If he has 13 contributions he can then claim sick pay for a max of 50 days (10 weeks) in any one year by having his employer fill out an SP1 form.

If he is not a member of the CWPS, he won't be able to claim this sick pay.

All employers in the construction industry have to register their employees with CWPS and pay contributions. The employer and employee pay a contribution, it would be on your brothers payslip. Sick benefit is part of this contribution that is paid and as the previous poster said you are entitled to 10 weeks of holiday pay.I dont think that employers are obliged to be members, I believe that all contrustion workers are to be part of the CWPS, no exceptions.
Double check if brother is paying these contributions or maybe ring the CWPS and see if his employer is paying his contributions. All employees are entitled to get a statement from the CWPS to see if there contributions are being paid.
