Complex VAT question - need a specialist

Hi all,

I've spent most of the day on the revenue's website and also trawling through HM Customs & Excise on VAT rules and regs. I haven't been able to figure out my VAT question so I'm wondering if any of you can recommend an ac****ant or tax advisor who could advise. I have written to my local tax office but haven't been able to get any clarification and I need some answers asap.

If you require a VAT specialist I can recommend one I ( as an accountant) have used a few times and have been very happy with the service given. Bear in mind VAT specialist opinions from the calibre of person I use would be at a cost of around €300+VAT/hr.
 
Ok - here is the jist of what I'm trying to work out.

My company is VAT exempt (confirmed in writing by local tax office). One of my suppliers is a UK based consultant - he charges me for the service he supplies + VAT. However, I can see from the UK tax website that the following rule should apply:

'If you are in the UK and the place of supply is in another EU country, you can zero rate the supply if the customer is a business. However, you must charge and account for UK VAT if the customer is not a business, and you may need to register for VAT in the country of supply'.

Because my business is not required to register for VAT, I do not have a VAT number - is this why my UK consultant charges me VAT?

Isn't this a question to ask the UK consultant, instead of asking a VAT specialist?

Can you not send a copy of your exempt certificate issued by the vat office here? The Uk co just needs to keep a copy of this on file.

If your company is VAT exempt, the Revenue will provide a VAT exemption certificate and a VAT number. In other words you will be registered for VAT purposes, but exempt.

This is probably because your business's turnover is below the VAT registration threshold and it is not the same as being VAT exempt.

Yes and is legally obliged to do so as your are not operating a VAT registered business.

Are you a sole trader?
