Good point.
Anyway, bad things happen and most of the time we should just suck it up and move on. It's character forming. I've had doctors screw up (like incorrectly splinting my finger when I'd a broken hand) but pointed out the error and had it corrected. I've also been in minor car crashes where I had minor injuries that healed up within a few months. I wouldn't dream of looking for compensation for either.
In this case I think it's a shame that it wasn't thrown out of court and costs awarded against the people who took it.
