Company being taken over

Hi All

I saw a few similar threads when I did a search but i needed to ask a couple of other questions so I made a new thread.

Basically I am working for a large IT company for the last 4 years and they have me working onsite on a large customer site for the last 2 years. the contract with the customer I am onsite with has been lost and i have been informed I am eligible to TUPE across but have some questions about whether it will be worth my while.

I am on a basically low salary which is topped up by my oncall allowance, I am oncall every second week. I also have a company jeep and fuel card.

My question is are the new company only entitled to meet my basic salary ( even though my yearly review takes into account my oncall etc) and also what is the storty with the company car and my fuel card. What obligations do they have towards these? My personal mileage is also paid for.

I'm a bit confused. You refer to the loss of contract in your post, and to company takeover in the thread title. Did both of these things happen?

Is there any BIK liability for the jeep?
 
Sorry that was a stupid heading of me to put on the post!! My company isnt being taken over, its just that the contract I am on has been lost...

No I do not pay any BIK for the jeep, it is a commercial Santa Fe
 
Depends on wording of contract ...


The On Call may be maintained in contract, but not used, so you lose this money because of no callout.

TUPE covers contracts, not your working arrangements


TUPE does not cover pensions , so if you move between companies , they have no obligation to meet past pension scheme, but generally make offer to cover pension into basic wage.

TUPE doesn't come into it so. TUPE only applies to takeover situations.

Are you an employee of the large company, or a sub-contractor? What does your contract say about your benefits? Are the jeep and the on-call allowance detailed there?
 
TUPE does not only apply in takeover situations, it can also apply in the case of where a contract or operation is outsourced out to another company
 
Can you not get redundancy from your current employer then join the new company, also what does Tube stand for?

I can't see how the [broken link removed] applies to this scenario. The business is not being transferred. The business has been lost by the employer.
