If party 1 is not registered then report him to the revenue or at least treathen him with the report.

Your brother was a bit silly to allow this person to handle money for him when he didn't really know him. (i guess he already knows that)

I think your brother should get the guards involved.

To be honest i don't think the guards will laught. There are plenty of people caught out like this. Its a serious matter especially with the large amount of money involved.

As your title states its Fruad and the guards deal with this the whole time

have the goods or services been delivered to the customers that party 1 ( let's call him George !) sold to. If not is the agreement of sale of these customers with George and if those customers do not get the goods / service, they will pursue George?

Looking at the bigger picture, are the customers likely to be repeat customers and is it important to maintain the reputation of the business? Is it your brothers good name that is being used by George or is he in fact acting as a reseller as if the goods / services were his to sell?
 
This looks to me like a commercial dispute between two parties. You should get advise from a solicitor who specialises in these type of disputes.

Did your borther have any kind of a contract with the person acting on his behalf in Ireland?
