Can my partner claim my tax credits

My partner and I are in a 5 year relationship, living together, mortgage together, plans to get married etc.
My partner is currently working whereas soon I will not, can he claim my tax credits or is that only the case if we were married?
My partner is currently legally separated and planning on completing the divorce in September, I don't know if that makes any difference.
 
The short answer under current legislation is that you need to be married in order to transfer credits - this is due to change but who knows when.
