Hi all,
I have a S23 property which I have rented out since 2006. All my tax issues are up to date and I have made returns annually. This property is in my name only.
My wife has a property which she purchased before we got married and this is solely in her name. This has always been her PPR. This has also been my PPR since we got married. We are due to be moving into a new house which we built next autumn and intend to rent out her property after this.
Can I declare the future rental income from her property on my form 12 tax return thereby taking advantage of my S23 tax relief or would she have to file her own return without availing of my S23 relief?
Would we need to have the ownership of my wifes property transferred into joint ownweship legally to use the S23 relief?
