I am a PAYE worker while my husband was self-employed. As he is no longer working, he does not receive any benefits because he was self-employed. Can I claim any extra tax-free allowance now as I am supporting him and he has no income whatsoever.?

how are ye assessed all along. if ye were taxed as a married couple make sure your the assessable spouse. If ye are taxed as single people get jointly assessed you'll get another credit and srcop to 45000 ish. If ye have any kids ye could claim home carers allowance 900 pa

I rang the tax office and got sorted to be jointly assessed for this year. The lady I spoke to said that she could not work on 2009 until the time came for my husband to file his returns for 2009.As he has no returns to make - because he wasn't working - we asked the accountant to send a letter to say this but he thinks that Revenue will not backdate the joint assessment and so I will not get any tax back ....does anyone know if this is the case or not...????

Onway,

If your husband is still on Revenue's records as being self-employed then he should submit a return for 2009 showing his income as nil and including your pay and tax details. Make sure to include your ppsn if you have not previously been jointly assessed.

Assuming you were married prior to 2009 then you can indeed use his credits but as I said paye will not/cannot deal with a person who is registered as self-employed. He will presumable need to deregister by contacting registration section.

The default position for a married couple is joint assessment. You would only be separately assessed if one of you had requested this.
