My brother started working for a company 3 years ago signed a contract for this company who trades a say xxxx.But this company xxxx was taken over by a company called yyyy a few years before he started.All his payslips state yyyy on them.It was brought to his attention by some one he got to know that other people who have always worked for yyyy in the same building but for a different business area altogether seem to have better conditions even though they are on a lower grade.My brother is a grade D which results in 23 days holidays but no medical cover.Grade C which is a lower grade than D has 27 days holidays and has full medical care with VHI.A person who is a grade D in yyyy gets full medical and 30 days holidays.

Of course. My boss has more responsibility than me and gets paid tens of thousands more for example.
 
I know that, but where one worker is on a lower scale than another but is entitled to more benefits eg health cover,more holidays just because they have always worked for the main company,not the new company that was bought

The answer is yes. This kind of situation occurs quite a lot.

I worked for a while for a company that acquired a number of other companies. Under the TUPE (Transfer of Undertakings Protection of Employees) regulations the employees of the acquired retained their T&C's. Some times the T&C's were better than the parent company and sometimes they were worse.


On a related point in a greenfield situation there is nothing to stop an employer having different unique T&C's applying to each employee! Providing of course that these comply with legislation (minimum wage etc) and are not discrimatory. (eg women paid less than men).

ability and knowledge is why people get paid more than others, thats why he is the boss!

Yes; this is common and it is legal. TUPE legislation is there to protect what you have not give you better than you signed up for. OP, if the conditions of the employees in company YYYY was worse would your brother be so concerned?
 
I think Tesco is a good example of what the OP describes. Many of the older Tesco staff are still working from Quinnsworth contract which had different terms and conditions than Tesco's. They all work side by side on the same checkouts
 
Works the other way had well, company I work for has transitioned people into it from other companies they took over or where a company outsourced the work and staff to us, often the staff coming in had T&Cs better then ours

Quite common as well in banks, every few years they have a tendancy to change the T&Cs for new recruits but leave existing staff T&Cs alone
