Hi folks,

I'm living in an apartment complex and pay my annual maintence once a year. Included in this maintence is refuse cost, bin buying cost and bin collection. Can I claim any tax back on this and if so what do I need to do?

I've paid complex maintence for the last 4 years, can this be back dated?

All advice appreciated.

Hi as service or bin charges are included in your maintenance fee then you are allowed to claim it back against your tax.

as regards what you do the easiest way is to registered on ros for paye and then claim it back that way.

I'm in a similar (apt) boat. I've never claimed for refuse charges and I won't have a tax liability (beyond my PAYE) in 2008. In 2009 however, I'll have a liability on rental income on a 2nd property. Would it make sense for me to 'store' up my tax rebate credits such as refuse and apply them all in 2009 to offset my tax liability ?

You can't store them up, they have to be claimed in the year to which the relevant charges relate. ( they go one year back by the way so in 2009 you claim 2008 & so on ) . Of course you can apply for them to be allocated in the relevant year & if you get rebates on each of those years (subject to the 4 year rule) you have that money to go against the liability on rental income.

Same here, owner occupier in an apartment, had not realized that those charges could be claimed back.

Do you claim the total of the maintenance fee, or just the refuse/waste portion?
Would it be the amount the management company actually spent or the amount that they had budgeted for?

:)
