Does anyone know if a BER Certificate is only required on properties sold or rented after 01/01/09 or does it apply to all properties sold or rented from 01/01/09?

whats the difference??

it applies to all properties available for sale or rent on 1 / 1 / 09...
so even if its for sale now, if its still for sale on 1-1-09 it requires a BER

Sorry I didnt make myself very clear, bascially, I've been renting for the past 7 months and I wondered if it only applies if you start renting or sell after 01/01/09.

if you changed dwelling, and reneted after 01/01/09.. you are entitled to ask to see the BER before you even consider renting....
once a property is advertised for sale / rent any interested party i sentiltled to ask to see the BER.

If you continue to rent as you are, then theres no legal requirement for your landlord to get a BER assessment done, until he needs to rent again... thats not to say you shouldnt encourage him to get one done, even for his own records...

The BERs will only have an impact if, when like with like are compared, the unit with the higher ratings demands a higher sale / rent price...
