Back garden invasion of privacy

Hi, I'd really like some advice on problem at my mother's house. It's in a row of semi-d's all built on the side of a steep hill. The back garden is 30 ft of flat ground and then a steep incline of around 50degrees of the remaining 40ft, so basically bushes and plants are grown on it.
The next door neighbour has just built a platform with a deck halfway up the hill, about level with the 2nd storey of the house. So when they're up there, they're looking directly into the ground floor & bedrooms of nearby houses!

Is this an invasion of privacy and can anything be done? the garden fence of about 6 ft high would need to be fairly dramatically increased in size and would be a bit of an eyesore.

A neighbour of ours built a platform similar to the one you describe without planning permission. Other neighbours complained about the privacy issue and the first neighbour was contacted by the council and asked to remove the structure.

He then applied for retention, which was refused and eventually had to remove the platform or the council were prepared to take him to court.

It would appear from this that your mother should have a good case for the removal of the platform.
 
wow, great news thanks. The neighbour has actually just built a conservatory so went through the planning process, but I didn't think you needed planning for something like this. Is there a particular dept. in the town council to contact?
