Can anyone tell me how fairly they act. Not wishing to get anyone into trouble or anything but I am really worried. A house is planned for a garden next door to me. The positioning of the propsed building is that the front of the house wd face my kitchen, bedroom and sunroom (but in the next garden). The front facade of the proposed building is about 14 feet from these rooms. It is really very close and will my kitchen to total darkness, I'm not exxagerating. The side windows will overlook my garden area and one of the bedrooms will have a view into my child's bedroom. My house value will drop immensely. Dublin City Council passed the plans based on the fact the the woman who owns the original house wants to build a house for her daughter becuase of the woman 'claiming' to be incapacitated. (She was loading a skip last week). The road is severely congested with traffic and they sent around a petition to the neighbours (quite a lot of them drink in the same pub, but I am not part of that crowd) and got them to sign that there was no congestion on the road. Everything is based on lies. DCC didn't want to know anything when I phoned them even though the plans that were passed were not the proposed house in question and even for a different council area.

I lodged an appeal with An Bord Pleanala and they came out last week. They went into the house next door, engaged in conversation and came out and went off. No-one knocked at my door even though I specifically asked that they come into my kitchen to assess the lighting impact. I rang and they wouldn't entertain me at all.

Sorry for ranting but I have worked hard for anything I have, without saying too much these other people haven't....I feel no-one is on my side and I am being dismissed. I have told the truth in all aspects of this case and so far it seems to have accounted for nothing.

Does anyone know how An Bord Pleanala operate (through personal experience) and is there anything I can do at this late stage.

I am sick over this whole thing.

the Bord take issues such as loss of light, overlooking and loss of privacy, etc... very very seriously. However, if the proposal doesnt constitute a loss of the above, which can be easily calculated and quantified, and it doesnt contravene other requirements of country development plans, local plans etc, then theres no reason why it shouldnt be granted.

they do not take personal issues into account... they cannot speak to you unless you request an oral hearing...

claiming devaluation is all fine and well, but this needs to be proved.... did you include a few auctioneers vaulations to show that there would be a devaluation??

once you have appealed, then this is all you can do... generally decisions with the bord can take anything from 16 weeks upwards....
 
Many thanks for your reply. I am hoping they don't take personal issues into consideration and just go by the facts and figures. The proposed building will be right on top of me and because of the proximity and height it will mean I might as well be in the shadow of a tower block, I am not making this up. I have had a sunlight/daylight analysis done. I wasn't, unfortunately, able to have a valuation done as none of the agents I rang wanted to get involve. As I said, everywhere I turn, no-one wants to help but others are falling over themselves to help this lying family....I dunno.

Hopefully the inspector is a person of integrity and realises that when I said there was severe congestion (posing danger) on the road that I was telling the truth, especially as when she was leaving she had to reverse halfway up the road to be able to turn her car around....
