Hi there, Can anyone tell me if I have grounds to have an appeal against me thrown out? I have applied for planning premission for a new house. I already have outline but someone objected to the full permission. The local council added 12 conditions to our planning in order to appease this guy. Now he has appealed to an bord pleanala but has told a lie about me. He says that I'm not indigenous to the area when it is in writing that I am. Is it okay for him to do this and if so does this mean that you can make any statement about someone, true or false, simply to delay their planning application? Thanks
 
firstly.. the 12 conditions would not be to appease an objector. It is very common for planning to be granted subject to conditions.

secondly, any person is within their democratic right to object and appeal a planning application. yes it delays the process, but it is something that should be considered from the outset....

thirdly, he can say whatever he wants in this appeal... its up to him to PROVE what he says...

forthly, you get an oppurtunity to answer his appeal, and in this answer its up to you to DISPROVE what he says....
 
Thanks sydthebeat, I've already disproved him with a reply. It was the exact same nonsence that I disproved when he objected to the county council. I just think that it's balls that someone can hold up my house for a year by writing something that they know is not true. The house doesn't even share a border with his land. He's just got a gripe with the planning department so he objects to everything.
 
Hi fabisma,
I know a friend of mine had the same trouble - her planning just got delayed by over a year due to someone appealing the planning, but it got sorted in the end and she is now happily ensconced in her home.
12 Conditions is fairly norm around Clare anyway - I got 16, so consider yourself lucky!
