Am I liable for a break to an unmarked NTL cable in my garden?

Just had a row of 20 year old Leylandiis removed, including roots.

There is some NTL cabling strung to a pole which was in the middle of this hedge.

My tree surgeon managed not to break this cable while felling the trees, which was good going.

However it is likely that he may have broken some surface / shallow cable while removing roots. We can't see any break but the neighbourhood lost TV reception while roots were being dug out by mini-digger.

There was no marker tape associated with the cable. I haven't investigated too much, except above ground and I can't see anything significant.

I guess NTL will come out on Monday as the neighbours have reported the fault.

Questions:

1. Can NTL hold me liable?

2. Can I be charged for the repair?

3. If so, is my tree surgeon liable (he is not a cowboy and is certified, insured etc as he contracts to the ESB)?

Update: got on to NTL, the customer service guy seemed to think I would have no liability. Good to know. Fingers xed he is correct.
