Am i entitled to maintenance if he's paying a mortgage?

Hi, does anyone know am i entitled to maintenance if the father is working full time and paying a mortgage? My name is still on the house we had but ive moved out as we split up last yr, i want to bring him to court as i dont think hes paying enough maintenace for 2 kids, (45 euro) a week, it states by law they should pay 60 euro minimum per child but someone else has told me it depends on his outgoings..... Can anyone clarify this for me. Thanks. S.

The amount of maintenance the father of your children will be ordered to be does depend on his income and outgoings. However the fact he is paying a mortgage doesn't preclude an increase in the level of maintenance he should pay. If you have disposable income of less than €18,000 you will be eligible for legal aid in case you do wish to get legal advice and go to court.
 
Thanks for the replys, i just dont want to go to court and end up lookin a fool if the maintenance is not increased. i wouldnt be eligible for legal aid. He is paying 45 euro for 2 children which i think is a joke, he should be paying at least that for 1 child.
