Am I an employee under Irish Statutory Law? I am with my current employer 5 weeks now. I think that they are three main areas of law governing my legal relationship with my employer; 1/. The employment contract 2/. Statutes 3/. Common Law.

However, do I have to be employed for more than one year with my present employer for Irish Statutory Law (Employments Acts) to apply to me? Does the length of my employment affect my rights in any way?

i would suggest reading department of enterprise website. if unable to locate info, it is no harm ringing them and explaning your concern and you should get an answer straight away. i sure they would sent you employment law publications or down load them. once on paye/prsi i see you as an employee.

Whether you are an employee or a contractor depends on the work you do and the agreement you have with your employer. Some employers will "employ" people as contractors under a "contractor agreement" but that in and of itself will not determine whether you are an employee or not. And whether you are an employee or not will affect your rights both under (2) and (3) above. Can you post some more detail on what you do and the contract you have with your employer? But yes, your summary above in 1/2/3 is correct in describing how an employment relationship is governed.

Certain statutes (most notably the unfair dismissals acts) only apply when you have been working with an employer for one year or more. Some others apply after two years (redundancy) and some apply the day you start work (anti-discrimination).
