Advice on Planning for Sale of House

I'm selling my house and the purchaser's solicitor has come up with two issues. One is they are looking for a certification that the conservatory complies with planning and the second is in relation to a gate that had been put up by the previous owner at the back of the property, it's been there for 8/9 years.

The conservatory measures less than 20 sq. mt. and is at the back of the house and I have been told that under 40 sq. mt. is exempt from planning so how is it possible to get it certified and by whom. Is it a red herring.

The gate probably never got planning permission but it is unused except for emptying the septic tank and has been in place for 8/9 years. Does it need planning now or is there some clause whereby if it is in place a certain period is it ok. Do I need the neighbours to state they have no objections to it.
