Access to Property

Hi there

I am in the middle of buying a property and my solicitor has brought it to my attention that access to the property from the main road is not satisfactory - you see, the vendor (who built the house) has an informal arrangement with a farmer (who owns the land which the access lane crosses) to use the access lane for 10 years. The property is just off a main road and the access lane is about 5 meters long crossing the farmers property. Does anyone know how to legally achieve usage of this bit of land? Incidentally the same lane is the access to the farmers land - further on from the property.

Vendor has to formalise the access arrangement by getting from the farmer (and registering) a formal written right of way. Without this, the property is landlocked and while relations may be cordial now between all parties, that cannot always be guaranteed. In any event, your lending institution will not complete without this being formally resolved.
