accepting & signing contracts for 2 job offers and then resigning from one

Hey all,

I've signed a contract of employment for company A. I got this job through an agency.

Company B haved offered me a position in the meantime and am awaiting the contract of employment.

Company B would be my preferred choice.

So the plan is to sign for company B and then resign from company A without starting as I don't start until the end of November.

Whats the worst that could happen to me?
Generally, people are saying nothing much will happen.

Any help would be much appreciated.

What doesn contract A say about resigning your position? Is there a probationary period?
 
Not a lot can happen to you I wouldn't think. The company would be entitled to seek specific performance from you, i.e. that you satisfy your contractual obligations, but they are unlikely to go to the time, trouble and expense.

Sorry for the delay in getting back.

There is a probationary period of 6 months in which wither party may terminate your employment in accordance with the provisions of the Minimum Notice and Terms of Employment Act.

Termination after the probationary period will be 4 weeks notice.

I don't think company A could do anything about it. Part of me is thinking something bad could happen in this situation.

Have you looked at the Act to see what these provisions outline?

Hi coovich,

Yep, read through the ACT. It doesn't really cover handing in your notice before starting. If the act can be applied to my situation, one weeks notice should be sufficent. I'm due to start in 2 weeks.

I'm 99% certain nothing could happen to me.

Hopefully, company b will get all my paperwork by tomorrow and then I can get this messy business out of the way.

Its just typical - search for ages for a new job and 2 come along.
