Statutory Notice
Under the Minimum Notice and Terms of Employment Act, 1973, employees are entitled to minimum notice periods as follows:
- Where an employee has over 13 weeks’ continuous service with an employer but less than 2 years’ continuous service they are entitled to one week’s notice.
-Where an employee has 2 years or more continuous service, but less than 5 years, they are entitled to two weeks’ notice.
-Where an employee has 5 years or more continuous service but less than 10 years, they are entitled to four weeks’ notice.
-Where an employee has 10 years or more continuous service but less than 15 years they are entitled to six weeks’ notice.
-Where an employee has 15 years or more continuous service, they are entitled to eight weeks’ notice.
Does that mean a three week contract (12 weeks) Doesn't qualify for a notice period in a contract?
The penalty for breech of contract would/should be stated in the contract.What if they just didn't bother finish out the contract? When people say hold you accountable what can they actually do? Court? Fine? Surely not?
