    Did mortgage 1 document state that you would also be funded for building the house on the site at a future undetermined point? If not, and I doubt it did, EBS did not have to offer a tracker on a second mortgage.

    I wouldn’t think decision will be soon. I submitted my case December 2017. Investigation ended September 2018. March 2019 they said it moved to drafting a preliminary decision. Now 16 months later still nothing. Once you move to drafting decision expect 12-24 months.

    I can’t get even speak to anyone to discuss things. I called and they said due to specifics around my case they cannot talk to me over the phone and everything needs to be in written form. I can’t understand how it has taken 30 months to get to to this point.

    Nothing, 17 months since investigation finished. My expectation is it will be in the next 4-12 weeks at which point I won’t be able to comment for 15 + 35 days. I hope I’ll be able to summarise at some point during the summer.

    “loans at variable rates will experience fluctuation reflecting interest rate changes” To me this reads as variable rates can change reflecting the banks cost of funds and does not indicate a tracker. Second point just related to a fixed break cost, noting to do with a tracker.

    Undoubtedly this is great news and I’m delighted the Ombudsman ruled in favour of this group but it’s a somewhat strange way of news breaking, via an AIB provision media release. FSPO has obviously made a number of preliminary and final decisions yet not a single comment from them.

    What is frustrating is that they have confirmed 13 decisions have been made - drafted, complete, done. They promised to publish this month. This is publishing documents which were completed last year but they have still failed to do so.

    Incorrectly lost my BTL Tracker. But sold BTL. Appeal rejected.

    Yeah it’s a joke. I guess the best thing to do is be grateful that the stupid process is over in the hope the FSPO will see that we are not a bunch of loons who sell property without consideration for the value of our investments
