Thank you for your kind words Bronte. I haven't seen the film yet but I'll definitely check it out. I hope that sharing the story will demonstrate to people in similar situations that there is hope and many ways to deal with difficulties.

Story of a Family Home Repossession

I just remembered this thread and thought how I never updated it. Time is flying by. We've a little more than 7 months till the stay runs out on the 01/06/17. We still feel it was the right thing to do. I've recently had an article published that covers this topic and many other aspects. It...

Getting help to fill bankruptcy forms

I think IMHO will do it for free. https://www.mortgageholders.ie/bankruptcy/ You could always do it yourself but you will need to get a PIP's approval for bankruptcy. I think there is a scheme to provide this consultation free. [broken link removed] If you do decide to have a go at it...

    ICB Report Post-Bankruptcy

That was my understanding of it too. They can only rely on their security now, outstanding balance is irrelevant. Perhaps it's an oversight, I'll get onto the bank and give them a chance to correct it.

    ICB Report Post-Bankruptcy

Thanks no_moolah, I'll have to get on their case too. I was hoping to see a line drawn through it after going through the bankruptcy.

    ICB Report Post-Bankruptcy

Just received an ICB report I ordered in the post. For my mortgage on my family home which is subject to a possession order with a stay till 01/06/17, it is marked as pending litigation and showing full amount owed. Is this an oversight or do I need to wait till house is in banks possession...

Bankrupt and still getting 'phone calls.

I had a similar issue with one particular creditor continuously contacting me despite being aware of my bankruptcy. I contacted the ISI about it and the sent me back a copy of my adjudication along with a message to send to my creditors. The message is below: Please find attached, your Order of...

OA contact with Bankrupts? 29th July discharge date approaching

I hadn't been contacted either so called them a moment ago and they confirmed I am scheduled for discharge on the 29th. They said a letter will be issued along with a Frequently Asked Questions page. A friendly lady picked up immediately, give them a call if you're worried 076 1064232

OA contact with Bankrupts? 29th July discharge date approaching

I wouldn't get too caught up on comparing what's happening to others. Focus on yourself, everything else is outside your control. Jim Stafford is a regular contributor here and could probably advise you. Worth a call. http://www.frielstafford.ie/ If you want to speak to a solicitor perhaps...

OA contact with Bankrupts? 29th July discharge date approaching

That's unfortunate. It goes against the whole spirit of a fresh start if they adjourned your case indefinitely. Your situation seems quite complex, you should get legal advice. I think it would be entirely reasonable to miss an IPA payment so you could afford a legal consultation.

OA contact with Bankrupts? 29th July discharge date approaching

In what way could the OA enforce an IPA post discharge?

Considering offering lumpsum to OA opinion needed

This is my understanding but you should definitely seek professional advice. An Income Payment Agreement (IPA) is an agreement between you and the OA to pay a set amount. This is informal and non binding. If you choose not to pay this, the OA can go to court and get an Income Payment Order...

OA contact with Bankrupts? 29th July discharge date approaching

My point is that I believe, come the 30th of July, all discharged bankrupts could legally ignore an outstanding IPA. The only way the OA can avoid this is by securing an IPO before discharge.

OA contact with Bankrupts? 29th July discharge date approaching

Sorry, I thought you meant they would try to set up the IPO after you had been discharged.

Considering offering lumpsum to OA opinion needed

Good luck to you too. Hard to believe it's less than a month! I don't think the OA will be able to enforce the IPA once you are discharged. Even if they could, I find it unlikely that they would accept. The IPA should be under review. If they accepted your offer you would be free to earn as...

OA contact with Bankrupts? 29th July discharge date approaching

I could be very wrong but I thought that an IPA must transition to an IPO pre discharge. Once discharged, the OA has absolutely zero right to enforce anything on you unless a court has ordered it while you were a bankrupt. Perhaps I'm wrong?

Haven't heard a thing from them either. Hoping it goes smoothly and we don't face any delays.
