Maybe. But you might want to reserve an equally heavy pinch to take with the guff about our allegedly wonderful solicitors.

    Probate office - Dublin

"The Courts Service informs me that up to sixty percent of applications are returned to solicitors due to errors. The significant error rate in these cases not only slows up the processing of these cases but also adds significantly to the time taken to process all other applications." Helen...

    Discretionary Trusts and Bankruptcy

If one of the beneficiaries of a Discretionary Trust is bankrupt, can the trustee postpone payment to that beneficiary until such time as the bankrupt has exited the bankruptcy process? If property is put in a Discretionary Trust for a beneficiary at a time when the beneficiary is going through...

Protecting an inheritance from creditors. Can a will contain a condition whereby the beneficiary..

Can a will contain a condition whereby the proposed beneficiary will only receive an inheritance if he/she is debt-free? (otherwise the inheritance would pass to other family members) I am thinking particularly of beneficiaries who might be in the middle of bankruptcy proceedings and whose...

Will bank agree to deal to accept half of joint residual debt?

Brendan She currently has about 80,000 in assets. All of which she would lose in a bankruptcy. Add to that the loss of earnings in the first year and possibly in subsequent years - not to mention the stress involved in moving abroad and the stigma of bankruptcy itself - and you can probably...

Will bank agree to deal to accept half of joint residual debt?

Thanks for replies. Given that the bank would be pushing both borrowers into bankruptcy resulting in hundreds of thousands more being written off, it seems like a no brainer to me. No? By accepting offer, bank recovers half the outstanding debt and is still at liberty to pursue the other...

Will bank agree to deal to accept half of joint residual debt?

In a situation where after a forced sale there is a shortfall and two parties jointly/severally owe €300k. One party can get lump sum from family and suggests an arrangement to bank whereby she agrees to pay back "her share" - €150k plus interest - over next 10 years. As part of the arrangement...

Receiver selling property without advertising it

FC Thanks for taking the time to reply. The property in question was sold within weeks. The decision on the part of the receiver not to advertise it or place it with an estate agent was never explained despite requests from the mortgagee to do so. Of course what the law deems reasonable and what...

Receiver selling property without advertising it

A bank instructed a receiver to take control of an investment property on which the borrower was unable to keep up repayments. Having sought "expert advice" the receiver decided against using the services of an estate agent and instead offered and sold the property to a buyer drawn from a...

Reasonable Living Expenses when partner bankrupt

Jim Thanks for that. Time, I think what jim is saying is that it would be unfair to creditors to allow the bankrupt to "use" the whole allowance. From what you are saying Jim I assume then that the non-bankrupt spouse would not be expected to provide more than 50% in any circumstance.

Reasonable Living Expenses when partner bankrupt

In a scenario where the husband is declared bankrupt how is his pay treated vis a vis reasonable living expenses? Is it the case that he will be entitled to keep an amount from his earnings up to half of the reasonable living expenses "allowance" irrespective of what his (non-bankrupt) wife is...
