KBC KBC - infamous flyer timeline

Anyone know just how many KBC tracker cases are with the Ombudsman ?

KBC Account split on one account number

This is not true. Lots of people got redress and compensation who did not have tracker or % above ecb in their paperwork as is detailed on many threads here

KBC I got tracker redress from KBC

If they were/are giving back trackers due to hardship this is potentially excellent news for many  ....widens it right out.... there'll be a long queue though. However it sounds more like they are just up to their usual tricks of pedalling half-truths, obfuscation and delay tactics...

15 cases decided. Ombudsman upholds 27% of tracker complaints so far. Dismissed 73%

Brendan are you basing the 27% v 73% figures (the headline on this thread) on the four cases out of 15 that have been upheld or partially upheld ? If so these are tiny numbers to be drawing any valuable inference from where there are 1174 cases still to be decided upon (not counting any new...

KBC tells Central Bank it's time to move on from their tracker focus

Well said Padraic you need to keep saying this and saying it publicly (outside of this forum).... we know that KBC and their ilk will only do the right thing when pressured into it

KBC Summary of the KBC Cohorts

It is not all about the flier Peemac. It is also not all about whether a person was on a tracker before roll off from fixed rate etc. People who never had mention of tracker in their contracts have been deemed impacted and redressed. The bank, kicking and screaming, have dealt with cohort...

KBC Summary of the KBC Cohorts

Yes indeed, sounds like private correspondence. The cases now will come down to what can be argued at the ombudsman. The banks including KBC used the so-called cohorts to group similar cases that they eventually deemed impacted and redressed. Reluctantly and only when they were caught out. It...

KBC Summary of the KBC Cohorts

Hi Sanparom, The thing is, KBC have said many things that later turned out not to be true. As the person who wrote in and the author's response in the IT article says, they cannot be trusted. They have been dragged kicking and screaming into the tracker investigation and have resisted all along...

KBC Summary of the KBC Cohorts

Hi folks. This issue is not over. It is not over despite what the banks, their cheerleaders and, yes, the Central Bank would like. Interesting query in The Irish Times today from somebody who is only now realising they could have been entitled to a tracker rate. No surprise that the issue of...

KBC Customer suing KBC over €202k redress inadequate

...These savings could otherwise have been used as a buffer to keep mortgages on track, which would of course have been best for bank, the country and individuals. This is not to mention the benefit to the economy had the overcharges amount been circulating rather than sitting in bankers'...

KBC Customer suing KBC over €202k redress inadequate

It is just not that simple.... personal finances are complex and the cause and effect is not easy to track in reverse. However banks themselves have agreed in 315 cases at least that their overcharge was the causing factor in the house loss. You assume banks were behaving reasonably and...

KBC Customer suing KBC over €202k redress inadequate

That's an incredible statement Brendan. The overcharging by the banks, that's every month over many years, forced people into financial breakdown and left them unable to pay their mortgages and many subsequently lost their homes...., had them repossessed, voluntarily surrendered them or sold...

If you have been deemed "not impacted" is it the end of the line for you?

KBC said today it will NOT use time limit to challenge ombudsman complaints. The Irish Times has the article here https://www.irishtimes.com/business/financial-services/kbc-moves-to-clarify-position-on-tracker-mortgage-time-limits-1.3997537

    KBC Appeals with KBC

My advice would be to request all files including audio by way of a data access request citing the legislation under which they are legally obliged to provide all information they hold in relation to you... That would be data protection legislation and pursuant to Article 15 of the General...

    KBC Appeals with KBC

Yeah we got two CDs from them eventually... through a data access request. We had to go back to them several times before the recordings were sent to us even though we asked for them in the first request. What we got was a lot of files many undated (none pre 2010) that were difficult to access...

If you have been deemed "not impacted" is it the end of the line for you?

Hi Brendan, (The fraud issue maybe needs a new thread...) I am not suggesting otherwise. The presumption of innocence remains whether or not there have been prosecutions yet or not or whether or not I or anyone else believes a fraud took place. It is a given, and raising it within the context of...

If you have been deemed "not impacted" is it the end of the line for you?

If people think the have a case they should take it to the ombudsman and not be discouraged because Brendan or someone else here thinks the statute of limitations might apply. I have a different interpretation of it than he has. It will be for the FSO to decide if it does apply, if and when...

If you have been deemed "not impacted" is it the end of the line for you?

Also if an overcharge continues to this day, which it would in most disputed cases, and legislation dictates that a case can be taken to the FSPO within 6 years of the conduct complained of, then there is likely to be no issue in taking cases to the FSPO.

If you have been deemed "not impacted" is it the end of the line for you?

Brendan just because there hasn't been a conviction or the central bank didn't uncover any evidence of fraud does not mean there was not a criminal offence of fraud or theft perpetrated. More is the pity there has not been any accountability through the courts for this scandal and let's hope...

If you have been deemed "not impacted" is it the end of the line for you?

On a recent Irish Times "Inside Business" podcast (https://www.irishtimes.com/business/business-podcast) at around 38 mins Brendan said those who were told by a bank they were not impacted are "now completely snookered". He went on to say: "They can't go to the ombudsman because it is statute...
